Back before the main point of making something was to sue people who made something similar, there was a legal dust-up between TSR and the Tolkein estate. It resulted in hobbits being renamed halflings, and dropping balrogs from the monster list. Maybe there were some other changes, but I'm not that interested in pre-1e history so I don't have all the details. My guess is that the resolution of that suit would be used by subsequent TSR and WOTC lawyers to get a new suit thrown out.
The other thing is that some of that emulation you see in the LOTR movies goes the other way. By the late 80s TSR's core artists were exerting a massive influence over how people envisioned fantasy worlds and creatures. If we hadn't had this, for example, the Peter Jackson LOTR might have looked more like Ralph Bakshi than what we ended up with.
