The side arguing the proposition holds the burden of evidence. They have to prove it by either a preponderance of evidence for a civil case, and beyond a reasonable doubt in a criminal case. Which standard is going to be used?

The evidence must represent either (1) factual evidence; (2) actual personal experience with the particular condition at question; (3) training or experience in the subject in question; (4) other evidence of a kind or composition such that it is of a credible nature that is capable of proving the proposition.

Opinion is not evidence. Mere assertions are not evidence. Conjecture, belief or lay opinion is not evidence. And the defense is entitled to argue to exclude evidence as being irrelevant, immaterial, and against the rules.

Oh, and what rules of evidence are being used? Colorado's rules of evidence? Maryland's? Wyoming's? Anyone's?
