I made a comment where I said that Buzzfeed didn't do anything wrong. The guy saw a tweet he didn't like and re-tweeted it. It was the intolerant mobs who didn't like her comments and her yellow employer who fired her for an off-the-job, non-employment related comment.
Look, if you work in an at-will state, do not have an employment contract, and you make a public comment that you like vanilla ice cream (which is the most popular flavor, even though I like strawberry more), your employer can use that as a pretext to fire you and unless you can prove that's not the real reason you were fired, all it means is you're now eligible for unemployment insurance for being fired not "for cause."
More than anything else it's that there's no protection for employer retaliation for private opinion and the First Amendment does not apply to non-government actors. As a notary public, as long as I accept customers from the General Public, since I am acting as a public official when I notarize a document, this is the only time the First Amendment applies to me personally since when I notarize a document I am acting as a state official and it does apply to me, which means I can't refuse to notarize a document which is otherwise in compliance with the law if I would normally accept that class of customer or that document from them if it were something else of the same type of notarial act. Not that I care as long as they have the two bucks, but it might bother some people. A notary who worked for a church might not want to notarize a document approving of abortion but they can't refuse if they normally handle documents from the public.
Now if you work in a real estate office and normally only do its own documents a notary can refuse to handle members of the general public.
