| Troy Davis, who has been convicted of cop killing in Georgia and sentenced to death, will be executed in about two hours. Georgia, it should be noted, is one of those states that had rape as a crime which was punishable by death until the U.S. Supreme Court found it was "grossly disproportionate and overly excessive" to impose death for a rape (Coker v. Georgia).
What surprised me was, in view of the fact the Supremes stated the penalty of death for rape was excessive, the number of people who got mad because Louisiana's penalty of death for rape of a child was also struck down (Kennedy v. Louisiana). Well, neither of these apply in this case, but it does show that some states are just rarin' to go to kill people if they don't like what they did a lot, whether killing them is the right answer or not. Anyway, barring divine intervention, Davis will get the needle at 7 pm tonight. The title of this was basically hyperbole, the electric chair has been retired for years, every state now uses lethal injection exclusively, but Virginia and Florida give the condemned the option of electrocution. (Nebraska's Supreme Court found its use of the electric chair violated the provisions on cruel and unusual punishment a couple of years ago.) I don't know if the furor over the potential errors in his case make much difference, whether or not he's innocent, he's going to die tonight. There's a lot of demand for the convicted to be executed, regardless of validity. It reminds me of Nancy Grace, her opinion is if you're arrested or tried you're guilty and if you don't get convicted it's a travesty of injustice. Oh, and as far as she's concerned, innocence is no excuse. I don't know if it matters much; everyone who is born is going to die; his difference is he knows the day, hour and minute. |
