Bloviate on, you shining star!

If you don't think lawsuits are out of control in this country, and that the consequences of having people sue, say, McDonald's because they chose to eat there every day and became fatasses, or sue airplane manufacturers 40 years after their airplane's manufacturing date for a malfunctioning seatbelt (which almost drove all American small aircraft firms/divisions out of business a few years back until product liability reform helped somewhat) are a problematic redifinition on a cultural and legal level of what responsibility means, then YOU have no idea how this country works.
Way to redefine, Ari! "Problematic redefinition on a cultural and legal level of what responsibility means" sounds so much more reasonable than the "PERSONAL RESPONSIBILITY GO REPUBLICANS SCREW DEMOCRAT TRAIOTR COMMIE PARTY HURRRRRR" shit from before. What the hell are you doing on Caltrops? Hie thyself to Washington, Mr. Smith! Shit, you'll pull Bush out of this Urani-gate scandal in no time. But in the meantime, not a word you said here invalidates the concepts of the common law system and the American concept of precedent that is based on it. Besides, do you think judges are morons? If a lawsuit has no merit, IT WILL GET THROWN OUT. Otherwise you're guaranteeing that corporate America can line up behind the collective asshole of the consumers of America and pound away for all they're worth. And they will. Oh yes, they will. And yes, this includes your own tortured starfish.
You can bloviate endlessly about semantic trivia,
"Semantic trivia"? About the division of government and the concept of precedent? Wait, are you one of those people who sits in a shack in Oregon anxiously awaiting the inevitable race war so you don't have to deal with them laws 'n suchlike? Or maybe one of those Republicans who wants to declare Bush emperor in the vain hope that your support might just make you one of the slavers instead of one of the slavees?
but it does absolutely nothing to change the reality of what is occurring in courtrooms thanks to a certain breed of trial lawyer.
Yeah. The kind that do their job. As opposed to letting politically motivated assholes who obviously know less than nothing about the law or the facts of any given case tell them how to do it for them. Which is, of course, the "proper redefinition" for "tort-reform advocates".
There is a significant difference between the sort of precedent which you claim covers this and what they are attempting, which is to (for example) make gun manufacturers nonexistent by suing them to bankruptcy over bullshit. What they could not accomplish (making guns illegal) through any legislative means, they will seek to make a reality in the future via lawsuits. No doubt since you probably agree with the "greater good" of their asinine leftist goals, you will forgive them anything.
Wow, excellent handle on what "they" want to do, right? Not that any strapping rock-ribbed Republicans (snort) would ever use the courts to try to influence the actions of the legislative branch, especially the NRA. Oh, wait, that's right. They're ALWAYS in fucking court, "bloviating" about the second amendment. And they always lose, because the lawyers and judges know the law better than they do (and you do). As do the "asinine leftists", which is why they know that when idiot right wingers write a stupid unconstitutional law (which is usually, witness PATRIOT, the DMCA, and all this "faith based" bullshit), they can usually get it thrown out. If the right wing wants to rewrite the constitution, then let them rewrite the constitution and see how that plays. Pulling this kind of backdoor "I'm going to pretend that the fundamental laws of the Republic don't exist because God told me so" bullshit is precisely why America needs the courts, and you need to sit the fuck down and shut the fuck up. Not because you don't have a right to speak, because you do... but because I love you, you silly goose, and I can't bear to see you look more and more ig'nint with each post. (On a related note, I miss AA.)
