If reports are to be believed then the devs are pretty sharp about EULA breaches. Mr Chinaman will get your money and your expensive new account may get a permanent ban.
The capital ships are really a corp/alliance investment. Used correctly (i.e. with support fleets) they are key strategic and tactical elements in the taking and holding of territory. Flown solo they are limited in effect and vulnerable to packs of smaller ships. If you really want to play with the big toys you need to ascend the ranks of your alliance (mMog) until they trust you with command of their billion ISK carriers and you trust them to support your 2 billion ISK dreadnought in the middle of a battle.
However you absolutely don't need billions in the bank to have fun and ruin other people's day. An established PvP role for newcomers is the tackler. Piloting the small, fast and hard to hit interceptors or even one of the better tech 1 frigates (cheap and disposable!) you scout, hunt down and warp scramble the target for those vital few seconds before the big guns can catch up and get a lock.
One of the most effective group tactics is the highly mobile and horribly difficult to counter interceptor/assault frigate fleet. Any lone battleship caught by one of these lethal wolfpacks is quickly converted to pod + can.
