Do I have to pay this? It's $40 for a 35 in a 25. Some people say I don't have to pay it.
You'll have to take care of it in some fashion; if you don't pay it or successfully challenge it, they will put a hold on your renewal and you will not be able to renew the vehicle's tags/registration until you pay the ticket plus probably penalties and interest.
There are ways you can get out of these but it depends on where you are. Sometimes you can by making a sworn statement that you weren't driving. Some require you to go to court and say that plus state who was, apparently you have to snitch on the actual driver.
There was one where we got a photo ticket in the mail showing the Jeep my sister and I jointly owned (which I drive) which had run through a red light, and the vehicle was caught on camera. I realized that I had done it.
Well, as it turned out, by sheer luck, the vehicle registration had her name first, so that was who was named on the ticket. You could get out of the ticket if you submitted a notarized affidavit that you (as the registered owner) were not the person driving. Well, that was true; she was not the person driving, I was. So, she signed the affidavit form attesting that she was not driving the vehicle (you're not required to admit if you know who it is), then I, using my commission as a notary public, signed the affidavit proving that she was known to me personally as the person named on the ticket. (Perfectly legal; I was not a party to the affidavit and the statement as made was 100% truthful.) I mailed it in and the ticket was dismissed.
