Re: You are aware of a branch of government called the 'Judicial', are you not?

Trial lawyers do a job. That job exists because the Constitution says the judicial branch gets to interpret the laws, and you need lawyers to argue the different sides of the case... hence the reason they're called advocates. Precedent does not make for "de facto laws"; it's part of the common law system that is older than the United States themselves, or the colonies for that matter. Wanking on about OMGSOEVIL trial lawyers only shows that you don't know shit how your country works. Is that clear enough for you, asshole?
If you don't think lawsuits are out of control in this country, and that the consequences of having people sue, say, McDonald's because they chose to eat there every day and became fatasses, or sue airplane manufacturers 40 years after their airplane's manufacturing date for a malfunctioning seatbelt (which almost drove all American small aircraft firms/divisions out of business a few years back until product liability reform helped somewhat) are a problematic redifinition on a cultural and legal level of what responsibility means, then YOU have no idea how this country works. You can bloviate endlessly about semantic trivia, but it does absolutely nothing to change the reality of what is occurring in courtrooms thanks to a certain breed of trial lawyer. There is a significant difference between the sort of precedent which you claim covers this and what they are attempting, which is to (for example) make gun manufacturers nonexistent by suing them to bankruptcy over bullshit. What they could not accomplish (making guns illegal) through any legislative means, they will seek to make a reality in the future via lawsuits. No doubt since you probably agree with the "greater good" of their asinine leftist goals, you will forgive them anything.
