I actually do think 3DR has a good defense here, because as an independent developer it's not their concern who is buying and selling the rights to publish their next game. This deal was between Take2 and Infogrames/GT Interactive. They knew they were buying the rights to something that hadn't been finished yet, they had no say in, was already massively delayed, and the major decision maker on the project was a morbidly obese manchild with a huge mullet. (and, right, nobody would have consulted him with over a publishing deal because he's not a publisher and would never again make anything anyone would publish... doesn't change the fact that, aside from that, people have been right about him being worthless for over a decade) Additionally, I am willing to make a long bet that Scott Miller will never "talk soon" about Duke Nukem Forever.
